The Rhode Island DMV eliminated the requirement of SR22 insurance Rhode Island for in-state license suspensions effective July 18, 2018. However, Rhode Island drivers with an out-of-state license suspension must purchase SR22 insurance from the state that requires it. If another state notifies the Rhode Island DMV of a resident’s SR22 requirement, the resident must prove that they have complied. If not, the driver’s Rhode Island driver’s license will be suspended.

Effective July 18, 2018, the Division of Motor Vehicles no longer requires drivers to carry SR22 insurance Rhode Island. Detailed information about Rhode Island license suspensions can be found on the Adjudication Office page of the Rhode Island DMV website.

Although the state no longer requires SR22 insurance Rhode Island for an in-state license suspension, the DMV will require you to carry SR22 insurance for an out-of-state license suspension. If you have an out-of-state filing, you must prove to the Adjudication Office that you filed an SR22 with the state that requires it, to avoid suspension of your Rhode Island license.

What is SR22 insurance Rhode Island?

SR22 is a guarantee of future financial responsibility. It’s an endorsement to your auto insurance policy, and you file the certificate with the state that requires it. The issuing insurance company monitors the policy to ensure that you maintain it for the time the state assigns.

You can expect to carry out-of-state SR22 insurance from one to three years, depending on the situation. If your insurance policy lapses at any time, the insurance company files an SR26 form. That state where you filed the SR22 certificate notifies the Rhode Island DMV that you’re no longer in compliance. This results in immediate suspension of your Rhode Island driver’s license. You must then repeat the filing process, which will likely require additional fines or fees.

Why another state may require you to file an SR22 certificate:

As of July 18, 2018, Rhode Island drivers no longer require SR22 insurance Rhode Island to reinstate their licenses. However, drivers will need to obtain an out-of-state SR22 filing if they have a license suspension in another state. Another state may require you to file an SR22 certificate if you commit a motor vehicle violation mandates a license suspension, such as:

  • DUI or DWI offenses
  • Driving without a valid driver’s license
  • Operating an uninsured vehicle
  • Uninsured accidents
  • Refusing to consent to a DUI or DWI test
  • Legal judgments
  • Unpaid child support

NOTE: If you need to file an out-of-state SR22 certificate without a vehicle, you’ll need a non owner SR22 insurance Rhode Island policy. Non driver insurance protects you with liability coverage when you operate a non-owned vehicle.
