Why do I need North Dakota SR22 Insurance?
Violation of North Dakota’s motor vehicle laws can result in losing your driving privileges. There are other reasons you may be required to carry North Dakota SR22 insurance. Some of the most common reasons for driver’s license suspensions are:
- Operating a vehicle without the minimum insurance required by the state
- Driving with a suspended license
- Excessive points (tickets) on your driving record
- At-fault or uninsured accident(s)
- Driving under the influence of alcohol or drugs, or DUI / DWI
- Refusing to take a test for detecting blood alcohol concentration (BAC) or other test
- Unpaid traffic tickets
- A child support case or other court judgment
What is the purpose of North Dakota SR22 insurance?
When your North Dakota license is suspended for any of the above infractions (or for other reasons) you’ll be required to buy high risk auto insurance – known as North Dakota SR22 insurance. SR22 insurance is a method of financially protecting all drivers on North Dakota roadways. It requires people who have committed serious traffic violations to be verifiably insured at all times for the duration of their license suspension period (usually a minimum of 12 months). If you cause an accident or have another serious motor vehicle violation, the other party will not be left to pay for injury or damage they were not responsible for causing. This is why the SR22 certificate is also called a financial responsibility form.
The North Dakota SR22 insurance certificate is filed with the North Dakota Department of Transportation (NDDOT) and is monitored by your insurance provider. If your policy ever lapses, you will not be allowed to operate a vehicle again until your SR22 insurance is reinstated. Naturally, will result in additional financial costs. It’s important to be aware that it is your responsibility to initiate the SR22 insurance process and to remember to renew 15 days before your certificate expires. The state does not notify you or send reminders.
How do I get a North Dakota SR22 insurance certificate?
After license suspension, you will not be able to drive at all for a certain time period. After that, you must provide proof of insurance (an SR22 insurance certificate) in order to apply and qualify for a Temporary Restricted License (TRL) for the remainder of your license suspension period. (Note: there are certain cases in which a TRL will not be issued.) The reinstatement process and fees and requirements will vary for each person, depending on the offense and/or the seriousness of the violation. You will have to contact the state to determine the requirements you’ll have to fulfill (which may include taking a driver education course, re-taking a written or driving skills test, completing an alcohol education program, etc.). You will also have to submit a financial responsibility form and proof of insurance to the state. For this you will find an SR22 insurance provider authorized by and licensed in the state of North Dakota to issue and file the certificate on your behalf.
Some of the costs associated with license reinstatement are reinstatement fees, a processing fee paid to your insurance provider, and your first premium payment.
License reinstatement fees are:
$50 for non-alcohol related suspensions
$100 for alcohol related DUI suspensions
You’ll need to purchase the minimum amount of liability insurance coverage required in North Dakota, which is 25/50/25 – $25,000 for one person killed or injured / $50,000 for two or more persons killed or injured / $25,000 property damage.
Your SR22 insurance rate depends on several factors. See How SR22 insurance costs are determined for further information about what insurance companies consider in setting SR22 insurance rates.
Your insurance agent will issue the SR22 certificate and file it with the North Dakota Department of Transportation. The NDDOT forwards it to the state, and when your SR22 is processed and accepted, your agent will send you a copy of the certificate (usually sent within 48 hours).
There are three ways to purchase North Dakota SR22 insurance:
- An SR22 Owner certificate insures vehicle or vehicles you own.
- An SR22 Operator certificate (also known as a Non-Owner certificate) insures you when operating a vehicle you do not own.
- An Owner-Operator certificate insures all vehicles you own as listed on the policy.
